The Regulatory Breakfast (Café Regulatório) is an in-person meeting hosted by Oliveira & Jacobovitz, in a breakfast format, to discuss betting advertising after the update to Annex X of the Brazilian Advertising Self-Regulation Code, approved by CONAR on August 27, 2026. The idea is a technical conversation with operators, agencies and affiliates about what changes in practice. There is no sales presentation and no pitch for services.

Why talk about this now

In just a few months, betting advertising changed on three levels at once. SPA/MF Ordinance No. 1,964 of July 3, 2026 standardized the mandatory warnings, which since July 17, 2026 must be horizontal, clear, legible and take up at least 10% of the ad. Interministerial Ordinance MF/SECOM/MJSP No. 73 of July 10, 2026 extended the duties of everyone involved in dissemination, from agencies to influencers and platforms. And the Annex X update restricted appearances in ads to people who are and look over 21, prohibited content appealing to children and adolescents, such as humanized animals, and encouraged regular ad monitoring and the accreditation of influencers and affiliates.

What changed in the CONAR Annex X update?

The update approved on August 27, 2026 restricted appearances in ads to people who are and look over 21, prohibited content appealing to children and adolescents, such as humanized animals, and gave more prominence to warnings. According to CONAR, the update takes effect 30 days after publication.

Which warnings are mandatory in betting ads?

They are the warnings standardized by SPA/MF Ordinance No. 1,964/2026, which begin with Ministério da Fazenda adverte and state that betting can cause addiction, that betting makes you lose money or that betting is not an investment. Since July 17, 2026, they must be horizontal, clear, legible and take up at least 10% of the ad.
