Law No. 14,790/2023 (Brazil's fixed-odds betting law) turned sports betting and online gaming into an authorised and supervised activity, with requirements on capital, governance, responsible advertising, responsible gaming, anti-money laundering and protection of player data.

This is a flagship practice of the firm. We advise operators, platforms, content providers, affiliates and investors on authorisation before the SPA/MF (Secretariat of Prizes and Betting of the Ministry of Finance), continuous regulatory adaptation, sector contracts and defence in administrative proceedings.

Yes, provided the operator holds a valid authorisation and follows the sector's rules. Law No. 14,790/2023 regulated the activity, and operating without authorisation is unlawful, exposing the operator to sanctions and to the blocking of its access channels.

What are the advertising rules for betting operators in Brazil?

Advertising must be directed at adults, disclose the risks of gambling, avoid presenting betting as a source of income and follow both the sector's specific rules and advertising self-regulation. Campaigns with influencers and affiliates require contracts with compliance obligations and control over the content published.

Does a betting operator have to comply with Brazilian data protection law?

Yes. The operation handles data that is high risk in practice: identification, financial data, betting behaviour and self-exclusion. That requires a defined legal basis, a clear privacy policy, security controls and a data subject channel under Law No. 13,709/2018 (LGPD).

Who is liable if an affiliate runs non-compliant advertising?

The operator will usually be held responsible for communications made for its benefit, even when a third party publishes them. That is why affiliate and influencer contracts should include compliance obligations, prior approval of creatives and an immediate takedown right.
