This Privacy Policy describes how Oliveira & Jacobovitz Advogados processes the personal data collected on the website www.oj.adv.br, in accordance with Law No. 13,709/2018 (the LGPD, Brazil's General Data Protection Law).

1. Data controller

Oliveira & Jacobovitz Advogados, registered with the Brazilian corporate taxpayer registry under CNPJ No. 37.225.391/0001-52, with offices at Avenida República do Líbano, 251, Torre C, Salas 2911 e 2912, Pina, Recife, PE, Brazil, postcode 51110-160.

2. Data we collect

We collect only the data you provide voluntarily and the data strictly necessary for the website to work:

  • Contact form data: name, email, phone or WhatsApp number, company (optional), subject of interest and the content of the message you write.
  • Job application data: name, contact details and the information contained in the CV you send.
  • Minimum technical data: IP address, date and time of submission and browser information, recorded for security reasons and to prevent fraud and abuse.

We do not request sensitive data through the website. Please avoid entering confidential information, health data, documents or details that could identify third parties into the form: those elements should be handled through a private channel, once the engagement has begun.

3. Purposes and legal bases

  • Responding to your enquiry and assessing whether we can act: consent as the legal basis (Article 7, I, of the LGPD) and, where applicable, preliminary procedures relating to a contract to which you are a party (Article 7, V).
  • Assessing applications for positions and for the internship program: consent (Article 7, I).
  • Website security, fraud prevention and access logs: legitimate interest and compliance with the legal duty to keep access records (Article 7, IX and II, of the LGPD, and Law No. 12,965/2014, the Brazilian Internet Civil Rights Framework).
  • Compliance with the professional and legal duties of the legal profession: Article 7, II, of the LGPD.

4. Professional privilege

Information relating to legal consultations is protected by the professional privilege set out in the Brazilian Bar Statute (Law No. 8,906/1994) and in the Code of Ethics and Discipline of the OAB, Brazil's bar association, in addition to the rules of the LGPD. Sending a message through the website does not in itself create a lawyer and client relationship, which is established only once the firm formally accepts the case.

5. Tools and data sharing

To run the website and respond to enquiries, we use third party services that may process personal data on our behalf, acting as data processors:

  • Google reCAPTCHA: a Google service used to distinguish human users from bots when forms are submitted. Its use involves the collection of technical data by Google, under Google's own Privacy Policy and Terms of Service.
  • Hosting and email delivery services: these store and transmit the messages sent through the form.
  • Internal notification automation: messages received through the website may be forwarded automatically to the firm's email, to the WhatsApp account of the team responsible for client intake and to a spreadsheet used to track enquiries, with restricted access.

We do not sell, rent or transfer personal data to third parties for commercial or advertising purposes. Data is shared only with those processors, within the limits of the purposes above, or where required by law, by a court order or by a competent authority.

Some of these services may store or process data on servers located outside Brazil. In such cases, we adopt the contractual and technical measures applicable to international data transfers under the LGPD.

6. Cookies

We use cookies that are strictly necessary for the website to work, for security and for your language preference. reCAPTCHA may use Google's own cookies. You can block or delete cookies in your browser settings, bearing in mind that some functions, such as submitting forms, may stop working.

7. Retention periods

  • Contact messages that do not lead to an engagement: kept for up to 24 months, as a record of the relationship and to check for conflicts of interest.
  • CVs: kept for up to 12 months from submission, unless you ask for deletion earlier.
  • Website access logs: kept for the applicable statutory period.
  • Data on engaged clients: kept for the periods required by professional, tax and procedural legislation.

Once those periods end, the data is deleted or anonymized, unless the law requires it to be kept.

8. Your rights as a data subject

Under Article 18 of the LGPD, you may request at any time:

  • confirmation that processing exists and access to your data;
  • correction of incomplete, inaccurate or outdated data;
  • anonymization, blocking or deletion of unnecessary or excessive data;
  • portability to another service provider;
  • deletion of data processed on the basis of consent;
  • information about who we share your data with;
  • information about the possibility of withholding consent and the consequences of doing so;
  • withdrawal of consent.

Requests should be sent to contato@oj.adv.br, identifying the data subject. We reply within the statutory deadline. Some requests may be limited by our duty of professional privilege or by a legal obligation to retain records.

9. Security

We adopt technical and administrative measures to protect personal data against unauthorized access, loss, alteration or improper disclosure, including encrypted connections, access control over our inboxes and restricted visibility limited to the professionals involved in the matter. No system is entirely immune to incidents: in the event of a relevant security incident, we will notify the affected data subjects and the Brazilian National Data Protection Authority, as required by the LGPD.

10. Minors

The website is not intended to collect data from children or adolescents. If it becomes necessary to process a minor's data in the context of a case, this will be done through a private channel, with the specific consent of the parents or guardians where required.

11. Changes to this policy

This policy may be updated to reflect legal or operational changes. The date of the last update is always shown at the top of this page. We recommend checking it from time to time.
