What makes litigation complex in Brazil?

It is a dispute where the amount at stake, the number of parties, the technical evidence involved or the impact on the business calls for strategic conduct and a dedicated team. It usually spans more than one area of law and develops across several instances or on parallel fronts.

Is it worth appealing to the Brazilian higher courts?

It depends on whether there is a federal or constitutional issue and on whether the admissibility requirements were preserved at earlier stages. That is why the decision to appeal starts long before the appellate ruling: it is built from the first pleading onwards.

How long does a high value case take in Brazil?

There is no standard timeline, because it depends on the procedure, the expert evidence, the volume of appeals and the court involved. What can be done is to estimate scenarios and to use urgent relief and partial settlements to unlock whatever cannot wait for final judgment.

Is settling a sign of weakness?

No. Settlement is a decision about risk and cost, measured against the likely outcome of the case and the time needed to get there. What is not advisable is settling without having modelled the judgment scenario and without having built a negotiating position.

Do you take over cases already handled by another law firm?

Yes. We take on cases at any stage, starting with an assessment of what has been done, what can still be corrected and what is now beyond recovery. The transition is handled professionally and respectfully towards the previous counsel, under Brazilian bar rules.
